By using ClosetCloud ("Service", "App", "we", "us"), you agree to these Terms of Service and Privacy Policy. Please read carefully before using our storage services.
By creating an account, you confirm that you are at least 18 years old and have the legal capacity to enter into this agreement. If you do not agree to these terms, you must not use the Service.
ClosetCloud provides physical storage services for personal belongings. We arrange shipping of your items to our facility, store them securely, and return them upon request. The Service includes:
3.1 Subscription Plans: We offer monthly subscription tiers (Starter, Plus, Pro Vault). Fees are charged automatically on the same date each month to your saved payment method.
3.2 Shipping Fees: In addition to your subscription, you pay per-box shipping fees when sending items to us and when requesting returns. Fees vary by subscription tier.
3.3 Payment Authorization: By saving a payment method, you authorize us to charge all applicable fees. Failed payments may result in service suspension and potential disposal of items after 90 days.
3.4 Cancellation: You may cancel your subscription at any time. You will retain access until the end of your current billing period. No refunds for partial months.
You agree NOT to store any of the following items. Violation may result in immediate termination and disposal:
5.1 Maximum Liability: Our liability for loss, damage, or theft of stored items is strictly limited to $100 per box, regardless of actual value. We do not offer additional insurance coverage.
5.2 Carrier Liability: For items lost or damaged during shipping (via UPS), claims are subject to the carrier's terms. UPS typically covers up to $100 per shipment.
5.3 Force Majeure: We are not liable for delays, damage, or loss caused by events beyond our control, including natural disasters, fires, floods, theft, government actions, pandemics, strikes, or carrier delays.
5.4 Valuable Items: DO NOT store items worth more than $100 per box. We strongly recommend obtaining third-party insurance for valuable belongings.
6.1 Accurate Information: You must provide accurate shipping addresses and contact information. We are not responsible for delivery issues caused by incorrect addresses.
6.2 Packaging: You are responsible for securely packing your items. We recommend using sturdy boxes and protective materials. Improperly packed items may be damaged in transit.
6.3 Item Valuation: You acknowledge that stored items have limited value and accept our $100/box liability cap. Do not store irreplaceable or sentimental items.
6.4 Account Security: Keep your login credentials secure. You are responsible for all activity on your account.
7.1 Storage Duration: Items may be stored as long as your subscription is active and payments are current.
7.2 Return Requests: You may request return of your items at any time via the app. Return shipping fees apply. Typical turnaround is 2–5 business days.
7.3 Abandoned Items: If your account is suspended due to non-payment for 90+ days, we reserve the right to dispose of your items without further notice. We will make reasonable efforts to contact you first.
7.4 Retrieval of Specific Items: We store boxes as complete units. We cannot retrieve individual items from within a box. To access specific items, you must request return of the entire box.
8.1 Subscription Fees: Monthly subscription fees are non-refundable. If you cancel, you retain access until the end of your billing period.
8.2 Shipping Fees: Shipping fees are non-refundable once a label is generated, except in cases where we fail to provide the service due to our own error.
8.3 Service Failures: If we fail to store or return your items due to our negligence, we will refund applicable fees and provide compensation up to our $100/box liability limit.
9.1 By You: You may delete your account at any time via the Profile page, provided you have no boxes currently in storage or transit, and no outstanding balances.
9.2 By Us: We reserve the right to terminate your account immediately if you violate these terms, store prohibited items, engage in fraudulent activity, or fail to pay for 30+ days.
9.3 Effect of Termination: Upon termination, you must arrange return of all stored items within 30 days. After 30 days, items may be disposed of.
You agree to indemnify and hold harmless ClosetCloud, its owners, and employees from any claims, damages, or expenses arising from: (a) your violation of these terms, (b) storage of prohibited items, (c) damage to our facility or third parties caused by your items, or (d) your breach of applicable laws.
11.1 Informal Resolution: Before filing any legal claim, you agree to contact us at help@closet-cloud.com to attempt informal resolution.
11.2 Binding Arbitration: Any disputes that cannot be resolved informally shall be settled by binding arbitration under the rules of the American Arbitration Association (AAA). You waive your right to a jury trial.
11.3 Class Action Waiver: You agree to resolve disputes individually and waive your right to participate in class action lawsuits.
11.4 Governing Law: These terms are governed by the laws of New York State, USA.
12.1 Data We Collect: We collect: name, email, phone number, shipping addresses, payment information (via Stripe), photos of your items, and usage analytics.
12.2 How We Use Data: Your data is used solely to provide storage services, process payments, send shipping labels, communicate about your account, and improve our services.
12.3 Data Sharing: We do NOT sell your personal data. We share data only with: Stripe (payment processing), UPS (shipping), Firebase (data hosting), and as required by law.
12.4 Data Security: We use industry-standard encryption and security measures. However, no system is 100% secure. You use the Service at your own risk.
12.5 Your Rights (GDPR/CCPA): You have the right to access your data, request corrections, request deletion (subject to operational requirements), and opt-out of marketing communications.
12.6 Data Retention: We retain your data for as long as your account is active, plus 7 years for tax/legal purposes. Deleted accounts are purged within 30 days.
12.7 Cookies: Our app uses minimal cookies/local storage for authentication and preferences. We do not use third-party advertising cookies.
We reserve the right to modify these terms at any time. We will notify you via email and/or in-app notification. Continued use after changes constitutes acceptance of new terms. Material changes will be effective 30 days after notice.
14.1 Entire Agreement: These terms constitute the entire agreement between you and ClosetCloud, superseding any prior agreements.
14.2 Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
14.3 No Waiver: Our failure to enforce any right does not waive that right.
14.4 Assignment: You may not transfer your account. We may assign our rights to a successor company.
